Le projet de loi Macron revoit l'obligation d'emploi de personnes handicapées
Recourir à des travailleurs indépendants handicapés pourrait contribuer au respect du quota de 6% qui pèse sur les entreprises de vingt salariés et plus. La mesure figure en tout cas dans le projet de loi Macron débattu en commission spéciale depuis le 12 janvier.
Pour rappel, ces dernières doivent employer au moins 6% de personnes handicapées, sous peine de devoir verser une contribution compensatrice à l'Agefiph ou au FIPHFP (pour la fonction publique). Aujourd'hui, elles peuvent atteindre ce quota via les diverses actions suivantes : salarier une personne handicapée, sous-traiter à des structures de travail adapté, accueillir des personnes handicapées en stage. Le projet de loi croissance et activité ajoute le fait de faire appel à des travailleurs indépendants handicapés.
De nouveaux débouchés pour les indépendants
"Cela peut représenter une opportunité de marché pour des personnes qui souhaiteraient créer leur activité, se félicite Annick Montfort, directrice de la prospective à l'Agefiph. Nous finançons chaque année environ 3000 projets par an. Mais il s'agit essentiellement de toutes petites structures. Il faut voir dans quelle mesure leur offre pourrait correspondre aux besoins des entreprises." Didier Roche, président de l'Union professionnels des travailleurs indépendants handicapés (UPTIH), se montre confiant : "comptables, juristes, avocats, consultants... tous ces profils peuvent intéresser le secteur privé".
La mise en situation professionnelle concernée
Le projet de loi Macron établit aussi que l'atteinte du quota de 6% puisse se faire en accueillant des personnes handicapées pour des périodes de mise en situation professionnelle. La loi de mars 2014 sur la formation professionnelle instaure ce nouveau dispositif, qui, en dehors de tout cursus de formation, permet de découvrir un métier ou un secteur d'activité. "Beaucoup de gens envisagent une reconversion à cause de leur handicap, explique Annick Montfort. S'ils peuvent avoir plus facilement l'opportunité de conforter leur projet professionnel, tant mieux."
